NEWS RELEASE: Missouri Department of Insurance Recommends Homeowners to Consult with their Insurance Agents for Earthquake Coverage

Jefferson City, Mo. – The Missouri Department of Insurance is encouraging homeowners to check their insurance policies for earthquake coverage. Only three out of every 10 homes are covered in Missouri. That number drops to two out of every 10 homes in the New Madrid Seismic Zone.
The New Madrid area is the most active earthquake zone in the U.S. east of the Rocky Mountains. Most homeowners insurance policies do not cover earthquake damage. Separate earthquake coverage, called an “endorsement,” must be purchased.
“Having earthquake coverage is the best way to ensure you and your family, as well as our state, can recover from an earthquake,” said Insurance Director John M. Huff. However, the department’s 2015 Earthquake Report shows that Missouri is experiencing a coverage crisis.
“We have reached a critical juncture where the amount of uninsured property in Missouri will soon eclipse the amount of insured residential property, estimated at $101 billion. This could jeopardize our ability to fully recover from a major earthquake.”
Some homeowners may not buy coverage, expecting the federal government to help rebuild their homes should a major earthquake hit, Huff said. Under FEMA’s Individual Assistance program, the maximum grant award is $32,900, far less than what most homes are worth.

Let’s say for example, you have 50/100/50. $50,000 is for Bodily Injury, Per Person. If you should have an accident and a person was severely injured and incurred $75,000 in medical bills, your insurance will only cover $50,000. $100,000 covers the Total Bodily Injury Per Accident. This is used when multiple people are injured in the same accident. So if you’re involved in an at-fault accident and 5 people are severely injured, your insurance will only pay $100,000 total.

This coverage is for bodily injury at the same minimums as those listed for liability coverage. Using the example above, the Uninsured/Underinsured Motorist Coverage would be $50,000. This amount protects you if you’re in a car accident and the other driver is at fault – and that driver has minimum liability limits or doesn’t have car insurance! This coverage also provides insurance for injury-related medical expenses and costs associated with repairing damage to your car.
Medical coverage is an important auto insurance coverage. Also known as Med Pay, medical car insurance covers the costs (up to a limit) for injuries that you, or your passengers may have when riding in and while loading or unloading the vehicle. Premiums for auto insurance can be extremely divergent and are determined by a number of factors. Gender is the major determinant for auto insurance premiums. Convictions for offenses will be sent to the Department of Public Safety for entry on your driving record, or to the Department of Natural Resources, and MAY RESULT in the loss of your license by those agencies.
In 2014, the Insurance Research Council News published an article in The Insurance Journal discussing the cost of uninsured motorist claims has risen dramatically in the past decade. Missouri law prohibits an uninsured driver, who is the owner of the vehicle or a driver operating a vehicle with or without permission who is uninsured, from collecting for non-economic damages in a civil action against an insured motorist alleged to be at fault for an accident. However, the limitation does not apply to passengers in an uninsured driver’s vehicle and does not limit the recovery of benefits provided or economic losses. Furthermore, recovery of non-economic damages in instances where an insured driver who is at fault because of operating a vehicle while under the influence of drugs or alcohol will still be allowed under the new law.
Be it enacted by the General Assembly of the state of Missouri, the law reads as follows:
- An uninsured motorist shall waive the ability to have a cause of action or otherwise collect for non-economic loss against a person who is in compliance with the financial responsibility laws of this chapter due to a motor vehicle accident in which the insured driver is alleged to be at fault. For purposes of this section, the term “uninsured motorist” shall include:
(i) An uninsured driver who is the owner of the vehicle;
(ii) An uninsured permissive driver of the vehicle; and
(iii) Any uninsured no permissive driver.
Such waiver shall not apply if it can be proven that the accident was caused, in whole or in part, by a tort-feasor who operated a motor vehicle under the influence of drugs or alcohol, or who is convicted of involuntary manslaughter under subdivision (2) of subsection 1 of section 565.024, or assault in the second degree under subdivision (4) of subsection 1 of section 565.060.
- The provisions of this section shall not apply to an uninsured motorist whose immediately previous insurance policy meeting the requirements of section 303.190 was terminated or non-renewed for failure to pay the premium, unless notice of termination or nonrenewal for failure to pay such premium was provided by such insurer at least six months prior to the time of the accident.
- In an action against a person who is in compliance with the financial responsibility laws prescribed by this chapter by a person deemed to have waived recovery under subsection 1 of this section:
(i) Any award in favor of such person shall be reduced by an amount equal to the portion of the award representing compensation for non-economic losses;
(ii) The trier of fact shall not be informed, directly or indirectly, of such waiver or of its effect on the total amount of such person’s recovery.
- Nothing in this section shall be construed to preclude recovery against an alleged tort-feasor of benefits provided or economic loss coverage.
- Passengers in the uninsured motor vehicle are not subject to such recovery limitation.

Foundation of Missouri Auto Insurance
An insurance policy is a contract between a policy holder and an insurance company. All policies are unilateral in that the policy holder pays the insurance company a premium. The purpose of an auto insurance policy is to make one whole, or return the policy holder back to their original condition prior to a covered financial loss. For example: you own a 2015 vehicle with actual cash value of $20,000 and the car was totaled by a covered peril. The recovery amount is limited to the amount of the actual loss incurred, and not the actual cash value – or replacement cost less depreciation.
Laws and Regulations
Missouri law requires motorists to have auto insurance. No owner of a motor vehicle registered in Missouri may operate, register, or maintain registration of a motor vehicle, or permit another person to operate the vehicle, unless the owner maintains the required liability coverage.

Missouri law requires all drivers to carry some types of coverage – at least state minimum – in the amount of $25,000 because of bodily injury to or death of 1 person in any 1 accident and, subject to the limit for 1 person, $50,000 because of bodily injury to or death of 2 or more persons in any 1 accident, and $10,000 because of injury to or destruction of property of others in any 1 accident.
The Missouri Auto Insurance Policy

- Bodily injury liability (BI) insurance covers you if you cause an accident in which someone else is injured. Your policy is designed to pay claims for each person injured in an accident, and limits the total paid per occurrence.
- Property damage liability (PD) insurance covers you when you damage someone else’s property. For example, your property damage will pay out when you are at fault for an accident that causes damage to someone else’s car.
- Collision insurance pays for damage to your car if you run into another object. This coverage is not required by law, although your bank may require it if you have a lien on your car. This is commonly known as “full coverage”.
- Comprehensive insurance covers you in case your car is damaged other than a collision. The covered perils include hail, fire, theft, flood, earthquake, explosion, falling objects, and encounters with wildlife, such as deer. Comprehensive is optional coverage and you may choose your deductible amount.
- Uninsured/Underinsured motorist (UM/UIM) insurance covers your expenses when you are hit by a driver who does not carry adequate, if any, auto insurance.
